1. Preamble
Moovehub is the trading name of Moove House Limited, a company registered in England and Wales (company number 15458312).
We are a member of The Property Ombudsman (TPO) and hold Client Money Protection through Money Shield. Our TPO membership number and CMP certificate details are available on request.
These Terms govern the Tenant Find service only and apply to residential lettings in England only. By purchasing our Tenant Find service, you agree to be bound by these Terms. They form a legally binding contract between you (the landlord) and Moove House Limited.
If you have any questions, you can reach us at [email protected] or through your Moovehub account dashboard.
2. Definitions
In these Terms, the following words have the meanings set out below:
"Service" means the Tenant Find service described in clause 5, as purchased through the Moovehub platform.
"Landlord" or "you" means the individual or entity purchasing the Service.
"Property" means the residential property in respect of which the Service is purchased.
"Tenant" means a prospective or confirmed tenant introduced to the Landlord through the Service.
"Listing" means the property advertisement published on Rightmove, Zoopla, and/or other partner portals through Moovehub.
"Portal" means any third-party property advertising platform on which Moovehub publishes Listings.
"RRA" means the Renters' Rights Act 2025 and any subordinate legislation made under it.
3. Use of the Platform
By using the Moovehub platform you agree that:
- All information you provide is accurate and up to date, including property details, photographs, and contact information.
- You will not use the platform to distribute unlawful, misleading, or harmful content.
- You will not impersonate any person, create false listings, or use automated tools to harvest data from the platform.
- You will not use the platform to contact tenants for purposes other than those directly related to letting the Property.
- You are responsible for keeping your account credentials secure. You are liable for any actions taken through your account.
- You will not attempt to interfere with the operation of the platform or other users' access to it.
All conduct on the Moovehub platform must be respectful and professional. Messages sent through the platform are subject to screening. Any of the following may result in immediate account suspension and forfeiture of fees paid to date:
- Abusive, threatening, or discriminatory communications directed at tenants, Moovehub staff, or any other party.
- Multiple attempts to circumvent platform guardrails or messaging filters.
- Repeated requests to obtain the other party's direct contact details outside of the platform process.
- Any attempt to conduct, or to solicit, a transaction outside of the Moovehub platform in order to avoid our fees.
4. Proof of Ownership and Authority to Let
The Tenant Find service is designed for private landlords letting their own property. It must not be used for sub-letting, or by third parties such as letting agents, without our prior written consent. By purchasing the Service, you declare that you are either the owner of the Property or have the explicit written permission of the owner to market and let it and to enter into arrangements with Moovehub on their behalf.
Before a Listing is published, Moovehub will request and verify evidence of your ownership of, or authority to let, the Property. This is a mandatory step and the Listing will not go live until verification is complete. You agree to provide such evidence promptly upon request. Acceptable evidence of ownership includes a copy of the title register from HM Land Registry, a mortgage statement, or such other document as Moovehub reasonably requests.
Where you are letting on behalf of a third party (including but not limited to a family member, company, or another individual), you must provide written consent from the property owner authorising you to market and let the Property and to enter into arrangements with Moovehub on their behalf. Moovehub reserves the right to contact the property owner directly to verify that consent.
You agree to indemnify Moovehub against any loss, claims, actions, or proceedings brought against Moovehub as a result of a breach of this clause, including any reasonable legal or enforcement costs incurred. Where fraudulent or misleading documentation is provided, your account will be suspended immediately and all fees paid will be forfeited.
5. The Tenant Find Service
The Tenant Find service is a one-off advertising and introductory service. For the fee set out on our website at the time of purchase, Moovehub will:
- Give you access to our platform to create your Listing, which we will then publish on Rightmove, Zoopla, and/or other partner portals and websites.
- Deliver tenant enquiries directly to you via your Moovehub account dashboard in real time. Enquiries submitted through Rightmove, Zoopla, the Moovehub website, and other partner platforms are passed to you instantly.
- Facilitate the introduction of prospective tenants to you.
The Tenant Find service does not include:
- Managing tenant enquiries or arranging viewings on your behalf. You are responsible for responding to all enquiries promptly and arranging viewings directly with prospective tenants.
- Negotiating or agreeing tenancy terms on your behalf.
- Managing the tenancy after a tenant has been introduced.
- Providing legal advice in connection with any letting.
Moovehub acts as an introductory agent only. Once a Tenant has been introduced, your relationship with that Tenant is directly between you and them. Moovehub has no ongoing role or responsibility in connection with the tenancy unless you separately purchase a managed service.
Moovehub reserves the right to change, add, or remove the property portals and partner platforms on which Listings are published at any time, without notice and without liability. No refund will be issued as a result of a change to the portals on which your Listing appears, provided it continues to be advertised on at least one portal.
Moovehub accepts no liability for errors, omissions, or inaccuracies in your Listing arising from technical faults, system errors, or human error in the processing of information you have provided, provided we take reasonable steps to correct any such error once it is brought to our attention. You are responsible for reviewing your published Listing and notifying us promptly of any inaccuracy.
Moovehub does not guarantee the volume, quality, or timing of tenant enquiries generated by your Listing. Enquiries are delivered to your dashboard as and when they are received from Portals and partner platforms. Moovehub accepts no liability for any enquiries that are delayed, lost, or not delivered due to technical issues affecting Rightmove, Zoopla, or any other Portal or partner platform, or due to any fault or outage affecting the Moovehub platform itself. You are responsible for checking your dashboard regularly and for contacting us promptly if you believe enquiries are not being delivered correctly.
6. Landlord Legal Obligations
By using the Service you confirm and warrant that:
- You have the legal right to let the Property and will not breach any law, agreement, or contract by doing so, including the terms of any mortgage or superior lease.
- Where consent is required from a mortgage lender, freeholder, or any other third party to market or let the Property, you have obtained it.
- If you are required to hold a landlord licence, HMO licence, or any other regulatory licence in the relevant area, you hold and will maintain that licence for the duration of the tenancy.
- The Property is fully compliant with all legal requirements applicable to privately rented residential property in England at the time of listing and throughout any tenancy arranged through the Service, including (without limitation) all safety, licensing, and energy efficiency obligations.
- The Property has a valid Energy Performance Certificate (EPC) with a rating of E or above, or you hold a valid exemption, as required by law. If the Property does not hold a valid EPC, or the rating falls below the minimum required by law, you must arrange for one to be obtained before your Listing can go live. Moovehub can arrange an EPC on your behalf as an add-on service at the prevailing rate. No refund will be issued where your Listing cannot be published, or is suspended or removed, because the Property does not hold a valid EPC or the rating does not meet the minimum legal standard.
- The Property has a valid Gas Safety Certificate (where gas appliances are present) and this will remain valid throughout any tenancy.
- The Property has a valid Electrical Installation Condition Report (EICR) as required by the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020.
- Smoke and carbon monoxide alarms are installed and in working order as required by the Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022.
- The Property meets all requirements for fitness for human habitation under the Homes (Fitness for Human Habitation) Act 2018.
- You will comply with all obligations imposed by the Renters' Rights Act 2025, including those relating to assured periodic tenancies, possession proceedings, the prohibition on requesting advance rent beyond one month, and deposit caps.
- You are aware that any tenancy created on or after 31 May 2026 will be an Assured Periodic Tenancy by operation of law. You are responsible for ensuring the terms of any tenancy you enter into are compliant with the RRA.
- Where Ground 1A under the Housing Act 1988 (as amended by the RRA) may be relevant, you understand and will comply with the statutory restrictions on re-letting or re-marketing the Property following recovery of possession on that ground.
- You will comply with the Tenant Fees Act 2019, including the prohibition on charging tenants any fees beyond those permitted as Permitted Payments under that Act, and the rules on holding deposits.
- All photographs, descriptions, and other content you provide for the Listing are accurate and you have the right to use them.
You are solely responsible for your compliance with all applicable landlord and property law. Moovehub does not verify compliance with legal requirements and accepts no liability for any failure by you to meet your legal obligations.
7. Compliance Documents
Moovehub does not arrange, obtain, or serve compliance documents on your behalf as part of the Tenant Find service. Unless you subsequently take out a managed plan with Moovehub, you are solely responsible for:
- Obtaining and holding a valid Gas Safety Certificate, Electrical Installation Condition Report, Energy Performance Certificate, and all other compliance documents required by law.
- Serving all required compliance documents on the tenant before or at the start of the tenancy, in accordance with your legal obligations.
- Ensuring any documents served are current and valid at the date of service.
If you take out a Moovehub managed plan following a Tenant Find instruction, and you provide us with copies of all required compliance documents no fewer than 7 working days before the tenancy start date, Moovehub will arrange for those documents to be served on the tenant on your behalf. Where copies are not received within this timeframe, the obligation to serve documents on the tenant remains with you.
8. Listing Content
The content of your Listing is your responsibility. You must not:
- Create more than one Listing for the same Property at the same time.
- Include photographs, descriptions, or other content that is inaccurate, misleading, or does not represent the current condition of the Property.
- Include content that discriminates against any person on the basis of a protected characteristic under the Equality Act 2010.
- Include content to which you do not have the rights, or that would infringe the intellectual property rights of any third party.
- Include personal data about any individual without a lawful basis for doing so.
By submitting content for your Listing, you grant Moovehub a royalty-free, perpetual, irrevocable, and non-exclusive licence to publish, reproduce, display, and distribute that content for the purposes of providing the Service. You warrant that you have all rights necessary to grant this licence.
All photographs and images submitted for use in a Listing must be your own or images for which you hold the necessary rights or licences. By submitting images to the Moovehub platform you warrant that:
- You are the owner of the copyright in the images, or have obtained all necessary permissions from the copyright holder to use them in connection with marketing the Property.
- The images do not infringe the intellectual property rights of any third party.
- Where images include individuals, you have obtained any necessary consents for their appearance in marketing material.
Where Moovehub receives a valid takedown request or copyright infringement notice in relation to images used in your Listing, we reserve the right to remove the relevant images immediately and without notice. Moovehub will notify you of any such request as soon as reasonably practicable. You agree to indemnify Moovehub against any claims, costs, or losses arising from your use of images to which you do not hold the necessary rights.
Moovehub is not responsible for verifying the ownership or licensing of images submitted by landlords and accepts no liability in connection with any copyright infringement arising from images you have provided.
Moovehub reserves the right to edit, remove, or decline to publish any Listing content that we reasonably consider to be inaccurate, misleading, unlawful, or in breach of these Terms or Portal requirements. We accept no liability for any content provided by you.
You agree to indemnify and hold harmless Moovehub, its directors, employees, and agents against any loss, liability, claim, damage, or expense (including reasonable legal fees) arising from or in connection with content you have provided for your Listing. This includes, without limitation, any funds reversed or charged back by a cardholder or their bank, or which a relevant enforcement body determines must be repaid in connection with your Listing or any transaction arising from it.
9. Holding Deposits
Where a prospective tenant pays a Holding Deposit in connection with a Property listed through Moovehub, the following applies:
- Holding deposits are subject to Moovehub's Holding Deposit Terms, available at www.moovehub.co.uk/legal/holding-deposits, which form part of these Terms and are incorporated by reference.
- In the event of any dispute between the landlord and a prospective tenant regarding the retention or repayment of a Holding Deposit, Moovehub's decision as to the correct outcome shall be final and no further discussion will be entered into once that decision has been made.
- Moovehub's decision-making role in Holding Deposit disputes exists to protect both parties and to manage Moovehub's exposure to payment disputes and chargebacks. By accepting these Terms, you agree to be bound by Moovehub's determination of any such dispute.
- Where Moovehub determines that a Holding Deposit should be repaid to the prospective tenant, you agree to co-operate promptly with any repayment process.
- Where Moovehub forfeits a Holding Deposit to you on the basis of evidence you have provided, you agree to repay the full amount to Moovehub within 14 days of a written request if a relevant enforcement body (including but not limited to a court, The Property Ombudsman, or Trading Standards) instructs Moovehub to return the funds to the tenant, or if the funds are returned to the tenant by their bank. You further agree to indemnify Moovehub against any reasonable losses, costs, or expenses arising from such a reversal or chargeback.
- Moovehub accepts no liability for any loss you claim to have suffered as a result of a Holding Deposit determination made in accordance with these Terms and our Holding Deposit Terms.
10. Tenancy Agreements
Moovehub's platform includes a tenancy agreement generator, which allows you to create and send a tenancy agreement for electronic signature. The following applies:
- The tenancy agreement is generated using information entered by you. You are solely responsible for the accuracy and completeness of all details entered, including (without limitation) party names, property address, rent, deposit amount, tenancy start date, and any special conditions. Moovehub accepts no liability for any loss, dispute, or legal consequence arising from incorrect, incomplete, or misleading information entered by you.
- You may add custom clauses to the tenancy agreement. Any such clauses are entirely your responsibility. Moovehub does not review, approve, or accept any responsibility for custom clauses added by you. You warrant that any custom clause you include is lawful, compliant with the RRA and all other applicable legislation, and does not conflict with the standard terms of the agreement.
- Moovehub does not alter the standard wording of the tenancy agreement template. The standard wording is provided for general use only and does not constitute legal advice. You are responsible for satisfying yourself that the agreement is appropriate for your specific circumstances. If you are in any doubt, you should seek independent legal advice before executing any tenancy agreement.
- The tenancy agreement is sent for electronic signature via the Moovehub platform. Moovehub's role is limited to facilitating the e-signature process. We do not act as a party to the agreement, do not verify its legal validity, and accept no liability for any failure of the agreement to achieve its intended legal effect.
- The landlord remains responsible for ensuring that any tenancy agreement, rent variation, or renewal complies with applicable law, including the RRA.
11. First Month's Rent and Deposit Collection
First Month's Rent
Moovehub will collect the first month's rent from the tenant on your behalf. This applies to all instructions, regardless of whether you subsequently take out a managed plan.
- The first month's rent will be disbursed to you within 5 working days of the tenancy start date. It will never be disbursed on the same day as the tenancy’s start date; disbursement will always occur on the following working day at the earliest.
- Where a dispute arises between you and the tenant in connection with the first month's rent, Moovehub will hold the relevant funds until the dispute has been resolved to our reasonable satisfaction.
- Following disbursement of the first month's rent, Moovehub can arrange ongoing rent collection if you take out a managed plan. This is not included in the Tenant Find service.
- If Moovehub transfers any funds to your account in error, you agree to repay Moovehub in full as soon as practicably possible.
Deposit
The law requires that any tenancy deposit taken from a tenant must be protected in a government-authorised scheme within 30 days of receipt. Moovehub will fulfil this obligation on your behalf by registering the deposit with the Tenancy Deposit Scheme (TDS) Custodial scheme.
If you wish to hold the deposit under your own scheme once it has been protected by Moovehub, you may request one of the following:
- (a) Transfer to your own custodial scheme: Moovehub will request that TDS transfers the deposit directly to your nominated scheme.
- (b) Transfer for use with an insured scheme: Moovehub will request that TDS releases the deposit to you so that you may register it under your own insured scheme. TDS may require additional information or documentation from you before releasing the deposit. You are responsible for providing whatever TDS reasonably requests promptly. Moovehub accepts no liability for any delay in release arising from your failure to provide the required information.
Any request under the above must be made within 14 days of the tenancy start date. Requests made after this period may not be actioned.
Moovehub accepts no liability for any failure by you to comply with deposit protection requirements following transfer of the deposit to you or your nominated scheme.
Client Money
All client funds received by Moovehub (including holding deposits, tenancy deposits, and rental payments) are held in a designated client money account, separate from Moovehub's own funds, in accordance with our Client Money Protection obligations. No interest earned on client funds held by Moovehub will be payable to the landlord, tenant, or any other party.
No Tenant Fees
Moovehub does not charge tenants any administration fees, viewing fees, referencing fees, or any other fees in connection with applying for or securing a tenancy through our platform.
12. Tenant Referencing
Moovehub offers an in-house tenant referencing service as part of, or as an add-on to, the Tenant Find service. Where referencing is carried out:
- The referencing report is produced for information purposes only. It is a summary of information obtained at the time of the check and does not constitute a guarantee of a tenant's suitability, creditworthiness, character, or future conduct.
- The decision whether to proceed with a tenancy rests entirely with you. Moovehub's referencing output is not a recommendation and is not binding on either party.
- Moovehub endeavours to obtain the most accurate and up-to-date information available, but cannot guarantee the accuracy or completeness of information provided by or about a prospective tenant, or by any third-party data source. The provision of a referencing report is not a representation that the information contained in it is correct.
- Moovehub accepts no liability for any loss, damage, or expense arising from your reliance on a referencing report. This includes, without limitation, rent arrears, damage to the Property, costs of recovering possession, or any other loss arising from a tenant's conduct or financial position, whether or not a referencing report was provided.
- Moovehub's referencing service is not designed or warranted to meet the requirements of any particular landlord insurance policy or rent guarantee product. It is your responsibility to confirm with your insurer or guarantee provider that our referencing output satisfies their criteria before entering into any tenancy. Moovehub accepts no liability where a referencing report does not meet the requirements of your chosen insurer or guarantee provider. A sample referencing report is available upon request so that you can confirm suitability with your insurer or guarantee provider.
- Referencing results reflect the position at the time of the check only. Moovehub is under no obligation to update or re-run a reference once issued.
- Referencing reports are confidential and must not be shared with the tenant or any third party without our prior written consent.
13. Right to Rent
Moovehub does not carry out Right to Rent checks on your behalf as part of the standard Tenant Find service. You are legally required to check that every adult tenant and occupier has the right to rent residential property in the UK before the tenancy begins, in accordance with the Immigration Act 2014.
Moovehub can, as an optional add-on service, arrange for a third-party to conduct in-person or Right to Rent document check on your behalf. Where you purchase this add-on:
- The check will be conducted by the relevant third-party provider, not by Moovehub.
- Moovehub is not responsible for the conduct, accuracy, or outcome of any check carried out by a third party.
- A statutory excuse will only be established if the check is conducted correctly and all legal requirements are met. You remain responsible for satisfying yourself that the correct process has been followed.
- Use of this service does not transfer your legal responsibility for Right to Rent compliance to Moovehub or to any third-party provider.
14. Third-Party Services
Some services available through Moovehub (including but not limited to Gas Safety Certificates, Electrical Installation Condition Reports, Energy Performance Certificates, inventories, and professional photography) are fulfilled by independent third-party contractors.
Where you purchase a third-party service through Moovehub:
- The service is provided by the relevant contractor, not by Moovehub. The contractor acts as an independent service provider and is not an employee or agent of Moovehub.
- Moovehub does not control the manner in which third-party contractors carry out their work and accepts no liability for their acts, omissions, errors, or delays.
- Where you have a preferred date for any appointment, we will use reasonable endeavours to accommodate this, but cannot guarantee availability or that any service will be completed by a specific date. Moovehub accepts no liability for any loss arising from a delay in delivery.
- All additional services (including but not limited to EPCs, EICRs, Gas Safety Certificates, professional photography, and inventories) are non-refundable once ordered, unless otherwise stated at the time of purchase or required by law. This applies whether or not an appointment has been completed where the order has been passed to a third-party contractor.
- Any complaint about a third-party service should in the first instance be raised with us and we will liaise with the contractor on your behalf. Our complaints procedure is set out in the Complaints Policy, available on our website.
- Moovehub may receive a commission or other financial benefit from third-party service providers. This does not affect your rights or the price you pay.
15. Tenant Fees Act Compliance
By using the Service, you agree that:
- You will not charge any tenant introduced through Moovehub any fee, charge, or payment that is prohibited under the Tenant Fees Act 2019.
- You will not require a prospective tenant to pay any fee as a condition of viewing the Property, making an application, being referenced, or entering into a tenancy agreement.
- Any Holding Deposit you take from a tenant will be limited to a maximum of one week's rent and will be dealt with in accordance with the Tenant Fees Act 2019 and our Holding Deposit Terms.
- Any tenancy deposit you take will not exceed the limits set by the Tenant Fees Act 2019.
Moovehub reserves the right to suspend or terminate your account if we reasonably believe you are in breach of this clause.
16. Accompanied/Hosted Viewings
Moovehub can arrange accompanied viewings at your Property upon request, fulfilled by an independent third-party contractor. To request an accompanied viewing, you must notify us directly through your Moovehub account or by contacting our team; viewings cannot currently be self-booked through the platform.
Where you purchase an accompanied viewing:
- Accompanied viewings are non-refundable once booked, except where you provide notice of cancellation no fewer than 24 business hours before the scheduled viewing time. Cancellations made within 24 business hours of the viewing will be charged in full with no refund issued.
- You are responsible for ensuring the Property is safe for the contractor and any prospective tenant to attend. This includes ensuring the Property is accessible, free from hazards, and that any known risks have been appropriately managed or disclosed to Moovehub in advance.
- Moovehub accepts no liability for any injury, loss, or damage arising from attendance at the Property where you have failed to ensure it is safe for access.
- The contractor attending the viewing acts as an independent service provider. Moovehub does not control the manner in which viewings are conducted and accepts no liability for the conduct, punctuality, or performance of the contractor.
- Moovehub makes no guarantee that an accompanied viewing will result in a tenancy offer or that any particular viewing slot will be available.
Prior to the viewing taking place, you must notify Moovehub of the access arrangements for the Property, including (without limitation) any key safe code, Keynest drop-off link, concierge arrangements, or other access method. Moovehub accepts no liability for a viewing being unable to proceed where access arrangements have not been provided or are incorrect.
17. Fair Use and Account Management
To protect the integrity of the Moovehub platform and the experience of tenants using it, we reserve the right to:
- Remove or suspend any Listing that we believe is inaccurate, stale, or being used to harvest tenant enquiries rather than genuinely let the Property.
- Contact you to confirm that a Property is still available, and to suspend the Listing if you do not respond within a reasonable time.
- Suspend or terminate your account if we reasonably believe you are in material breach of these Terms or are misusing the platform.
- Request documentary evidence to verify your ownership of or entitlement to let the Property, or that the Property holds the necessary compliance documentation.
You agree not to hold Moovehub responsible for any loss arising from our exercise of any of the above rights.
18. Pricing, Payment and Cancellation
The current price for the Tenant Find service is set out on the Moovehub website at the time of purchase.
Payment is due at the time of purchase. The Service will not commence until payment has been received in full.
You agree that as a landlord operating a lettings business, your purchase of the Tenant Find service constitutes a business-to-business transaction between you and Moovehub. As such, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply and no cooling-off period is offered. Moovehub begins providing the Service immediately upon receipt of your payment and submission of your listing for review.
Notwithstanding the above, Moovehub offers a 60-day money-back guarantee as set out in clause 19. This guarantee is provided voluntarily and does not affect or limit the non-refundable nature of the Service or any add-ons purchased separately.
19. Money-Back Guarantee
Moovehub is confident that our Tenant Find service gives your property the best possible chance of finding a great tenant. We therefore offer a 60-day money-back guarantee on the core Tenant Find fee.
If your listing has been live for 60 days from its date of first publication and you have not secured a suitable tenant, you may be eligible for a full refund of your Tenant Find fee. To qualify, all of the following conditions must be met:
- The asking rent is consistent with current market rates for the area and property type at the time of listing and throughout the advertising period.
- The listing photographs meet a reasonable standard of quality, presenting the property clearly and accurately.
- You have actively and promptly engaged with tenant enquiries received through your Moovehub dashboard throughout the advertising period.
- Where Moovehub has provided reasonable advice on pricing or presentation during the advertising period, you have acted on that advice within a reasonable timeframe.
Whether these conditions are satisfied is assessed by Moovehub, acting reasonably and in good faith. We will always aim to work with you to secure a tenant before the 60-day period expires, and our team is on hand to offer guidance throughout.
To make a claim under the guarantee, you must contact us at [email protected] before or within 7 days of the 60-day period expiring. Claims made outside this window cannot be accepted.
The guarantee applies to the Tenant Find fee only and does not extend to any add-on services purchased separately. It is available for residential lettings in England only, and may not be combined with any other offer or discount. Moovehub reserves the right to withdraw or amend the guarantee for future purchases at any time; any such change will not affect a guarantee already in force at the date of purchase.
20. Complaints and Redress
Moovehub takes complaints seriously. Our full complaints procedure is set out in the Moovehub Complaints Policy, available at www.moovehub.co.uk/legal/complaints.
21. Personal Data
Moovehub is the data controller of personal data it holds about users of the platform. Our Privacy Policy sets out in full how we collect, use, and protect personal data.
In the course of providing the Service, Moovehub may pass tenant personal data (including contact details and enquiry information) to you as the landlord. Where this occurs:
- You become an independent data controller in respect of that personal data.
- You must process that data only for the purpose for which it was shared (namely, progressing the tenancy enquiry) and in accordance with UK GDPR and the Data Protection Act 2018.
- You must not use tenant personal data for any other purpose, share it with third parties, or retain it for longer than is necessary.
- You are responsible for ensuring you have a lawful basis for any processing of tenant personal data that you carry out.
22. Limitation of Liability
To the fullest extent permitted by applicable law, Moovehub (including its directors, employees, agents, and subcontractors) will not be liable to you for:
- Any indirect, consequential, special, or incidental loss or damage, including loss of profit, loss of rent, or loss of goodwill.
- Any loss arising from your reliance on information provided through the platform, including referencing reports or compliance guidance.
- Any loss arising from the acts or omissions of third-party service providers, including contractors fulfilling add-on services.
- Any loss arising from a tenant introduced through the Service, including non-payment of rent, damage to the Property, or any conduct or actions of the tenant.
- Any failure by you to comply with your legal obligations as a landlord.
- Any technical or human errors in the publication, formatting, or distribution of your Listing, provided reasonable steps are taken to correct any error once notified.
Moovehub's total aggregate liability to you in connection with the Service will not exceed the amount you paid to Moovehub for the Service in question.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
If any provision of these Terms is found to be unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
23. Licensing and Memberships
Moove House Limited is a member of The Property Ombudsman (TPO) and subscribes to TPO's Code of Practice for Letting Agents. Details of TPO can be found at www.tpos.co.uk.
Moovehub holds Client Money Protection (CMP) through Money Shield, as required by the Client Money Protection Schemes for Property Agents (Approval and Designation of Schemes) Regulations 2018. Our CMP certificate is available on our website and on request.
Copies of the relevant codes of practice for any schemes of which we are members are available electronically on request.
24. General
- These Terms constitute the entire agreement between you and Moovehub in respect of the Tenant Find service and supersede any prior representations or agreements.
- These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the English courts.
- Moovehub may update these Terms from time to time and the updated version will apply to all active listings from the date of publication. We will notify you of material changes by email or through the platform. If you do not agree to the updated Terms, you may remove your Listing at any time. Continued use of the Service following notification of a change constitutes your acceptance of the updated Terms.
- You may not transfer your rights under these Terms to any other person without our prior written consent.
- A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of them.
